What is unfair administration?
Disloyal administration is typified in Article 252 of the Criminal Code and consists of acting to the detriment of the assets being administered, abusing the powers conferred. It is a crime against the patrimony, frequent in the business or corporate sphere or in the management of other people's accounts.
This crime is usually committed by a person who, having power of administration over the assets of others (such as an attorney-in-fact, administrator or partner), makes decisions that are detrimental to the owner of the assets or the company, acting disloyally or in breach of his or her management duties.
