What are crimes against the Public Treasury?
Tax offenses are considered to be those in which a person or company defrauds the tax authorities of more than 120,000 euros per tax year, either through false declarations, concealment of income or improper deductions.
These offenses are regulated in Articles 305 and 305 bis of the Penal Code and affect both individuals and legal entities. Social Security fraud may also be included.

The base penalty for an offense against the Internal Revenue Service is:
- Imprisonment from 1 to 5 years.
- Fine of double to six times the amount defrauded.
- Special disqualification to exercise economic activity or public office.
When the fraud exceeds 600,000 euros or there are aggravating factors such as opaque structures, front men or tax havens, the penalties may be increased.
