July 1, 2025The 14th Criminal Court of Madrid has handed down a conviction against a driver who, while intoxicated, fell asleep in his vehicle with the engine running and subsequently assaulted police officers who tried to wake him up. This case highlights the serious legal consequences of combining alcohol consumption with driving and resisting authority.
The Facts
In the early morning of July 1, 2024, the accused was found asleep in the driver's seat of his car, which was stopped in the right lane of a Madrid avenue, with the engine running and the emergency lights activated. When awakened by two National Police officers, the individual showed a hostile attitude, refusing to cooperate and stating that he was going home. Far from obeying the officers' indications, he started the vehicle, hitting one of them in the legs. The situation escalated when two other agents arrived, whom the accused assaulted with punches and kicks before being reduced and arrested.
Offenses and Convictions
The court has convicted the defendant of the following offenses:
- Attempt against the authority: 6 months imprisonment and disqualification for passive suffrage.
- Two minor offenses of injury: a fine of one month with a daily fee of 3 euros, in addition to compensation to the injured officers.
- Offense against road safety: a fine of six months with a daily fee of 3 euros.
In total, the convicted person must pay 1,650 euros in civil liability for the damages and injuries caused to the officers and the police team. The prison sentence has been suspended for a period of two years, provided that he does not commit new crimes and complies with the payment of compensation.
